Dean spanked for inflammatory comments

WASHINGTON Â— When Howard Dean was chosen to head their party, Democrats looked forward to the benefits of his bristling energy and zest for political combat.
But at a private meeting Thursday on Capitol Hill, a number of worried Senate Democrats warned Dean that he had been going overboard and needed to choose his words more carefully.
The former Vermont governor and unsuccessful presidential candidate recently referred to the GOP as "pretty much a white, Christian party" and declared that a lot of Republicans have "never made an honest living in their lives."
Sen. Russell D. Feingold (D-Wis.) said that at the Capitol Hill meeting, "there couldn't be any doubt that there was some concern, even by Dean himself," about how his comments had been received.
The meeting had been scheduled to discuss party strategy before Dean's controversial comments.
Also Thursday, two Democrats seen as rising stars Â— Rep. Harold Ford of Tennessee and Virginia Gov. Mark R. Warner Â— made a point of distancing themselves from Dean's remarks.
Ford, who plans a Senate run next year, said on the Don Imus radio show that if Dean could not "temper his comments, it may get to the point where the party may need to look elsewhere for leadership, because he does not speak for me."
Ford later told The Times that Dean was "leading us in a direction that makes it difficult to winÂ…. His leadership right now is not serving any of us very well."

3 There are still a lot of Democrats who are proud of Dean and defend his comments. They are criticizing those Democrats who are criticizing Dean. These criticizers are perilously close to being thrown down the stairs by their bretheren for being Dean Apostates. I would direct you to Kos as an example, but would highly recommend wearing a full body condom before hand and taking a decontamination shower afterwards.

But only one side can be right, and in this case, I think the liberals are wrong. Should the Left and Right we unite against the more obvious evils in the world? 17 YBP: Abortion! Yeah, touchy subject with many. It seems like a no-win argument to me since Liberals view not being able to choose as the government's control of a woman's body. They also feel that women will do it anyway, just less safe and illegal. Most of the Right thinks it's murder, which when it boils down is all about how you define life. Is it conception? Reflex? Movement? Having a nervous system? Pulse? Or does 2 or 4 cells alone qualify as a soul with a right to live? Is a stem cell life? If life is so important to the Right, then why does the right start so many wars? This is another Liberal accusation of the Right's hypocrisy...Bush talking about the importance of the "Culture of Life" while waging a war and being Mr. Death Row in Texas. Despite what anyone thinks in here, I'm not concrete on my view of many of these subjects. I am pro choice on abortion for a few reasons, but with a twist. I think only women should be able to vote or decide on the laws surrounding this. I also think that once a fetus has developed past a few cells and looks human, has a pulse and a developing nervous system, it is a person with a future...if the conception wasn't rape or molestation, I think it's wrong to abort. As far as which side is right? Neither. They are both wrong in my eyes. You can argue till you're blue in the face about who controls the media ex: NY-Times or MSNBC vs. FOX, etc. Maximus can have paranoid delusions about Liberals helping plan 9/11 with Osama and Liberals aiding terrorists in any way they can or the Liberals can have nightmares about the government controlling them, ruining the environment, and non-stop wars, etc. The right and the left all have polarizing opinions which I find quite unhealthy...just look at how divided the last election was and how much hate there was floating around. Is our country really two countries trapped in one? When is the last time it was unified? The only thing I do know is that I won't put myself in a little box called Right or Left. I think there are great things to draw from both, and then plenty or crap to dismiss as well. I do tend to form opinions based on logic rather than religion...for instance I think it's absurd to urge abstinence. The Pope must be insane to think that condoms aren't more important to stop AIDS in Africa, or that anyone can keep horny teenagers from fooling around. The day that all religions realize they cannot defeat nature, we will live in a better world. No religion or culture has EVER been able to keep people from having sex. Nature always finds a way, and in extreme cases (priest celibacy) the outcome can be quite nasty. I never hear about Rabbi so-and-so molesting tons of little boys. Sure, a Rabbi can screw around, but Judaism is messed up as well. I can find beef with almost any religion pretty quick. Enough of my rant...what do you think?

Even if I were not religious, I say it's best to err on the side of life--innocent life--thus destroying the argument who point out that pro-lifers should be against the death penalty too. And they should--the Church points out that it should be used sparingly. As for children born out of rape--I still see that baby as a person who deserves his right to life protected, even if the backgroung to his creation does not fit my ideal vision of how it should have come about. There has been abuse in other religions as well--Judaism, protestant, etc. And it's not because of the variuous churches, per se--it's because men in them do not listen to their teachings. But the R.C. Church is under attack the most because it is the one true Christian faith. Some older comments/arguments I made on another post: Calling abortion a "right" is a new trend. Protecting human life is not a radical new thing, but fundamental to the sanity of any civilized society. I'm positive the Founding Fathers, who discuss the God-given rights of those created by parents (and indirectly, through Him), would be aghast. Practically, 100% of a person's genetic makeup is determined at the moment of conception. Science and medicine define being a person (human) by genetic means. According to science and medicine, a fetus is a distinct organism. Thus, killing a fetus is killing a potential baby. Killing a child is killing a potential man or woman. It's killing innocent life, and that's what those who oppose abortion are against. No one is saying that babies should have "rights equal to or superior to a woman's." Pro-life proponents are simply saying that babies have a right to life. Regarding Development: Some imply that a fetus is not a thinking, feeling, conscious human being. Current, valid science indicates that a fetus is not a senseless mass of tissue, as some people have believed in the past. According to Planned Parenthood, a fetus is "the organism that develops from the embryo at the end of eight weeks of pregnancy and receives nourishment through the placenta; the fetus continues to develop until the pregnancy ends." According to Merriam-Webster's Collegiate Dictionary, Tenth Edition, an organism is "an individual constituted to carry on the activities of life by means of organs separate in function but mutually dependent : a living being". In other words, Planned Parenthood admits that a fetus is an individual, and a living being. According to Dr. Ruth's Encyclopedia of Sex, "The beginning of the fetal period [is] arbitrarily designated by most embryologists to occur eight weeks after fertilization. At this time, the embryo is nearly one and one-half inches long. Few, if any, major new structures are formed thereafter; development during the fetal period of gestation consists of the maturation of structures formed during the embryonic period." In other words, the basic structure of the baby has already been formed. Planned Parenthood admits this. Now, remember, this is still within the first "trimester." The baby has a small brain. The baby can feel pain. The baby can feel vibrations. The baby has vague vision and hearing. The baby has reactions which indicate a simple intelligence. Admittedly, the baby is undeveloped enough at this point that its sensations and thoughts are not similar to adults'. However, the baby is a thinking, feeling human being. I believe that laws should support this fundamental belief. Another set of arguments against abortion would be philosophical arguments. A key philosophical question is where do you draw the line? Put another way, when does a human being become a person? The Supreme Court's decision of Roe v. Wade separated personhood from humanity. In other words, the judges argued that a developing fetus was a human (i.e., a member of the species Homo sapiens) but not a person. Since only persons are given 14th Amendment protection under the Constitution, the Court argued that abortion could be legal at certain times. This left to doctors, parents, or even other judges the responsibility of arbitrarily deciding when personhood should be awarded to human beings. The Supreme Court's cleavage of personhood and humanity made the ethical slide down society's slippery slope inevitable. Once the Court allowed people to start drawing lines, some drew them in unexpected ways and effectively opened the door for infanticide and euthanasia. Look at the situation of the poor woman in Florida, starved to death. Regardless of her thinking capabilities, SHE WAS STILL A WOMAN. The Court, in the tradition of previous line-drawers, opted for biological criteria in their definition of a "person" in Roe v. Wade. In the past, such criteria as implantation or quickening had been suggested. The Court chose the idea of viability and allowed for the possibility that states could outlaw abortions performed after a child was viable. But viability was an arbitrary criterion, and there was no biological reason why the line had to be drawn near the early stages of development. The line, for example, could be drawn much later. Ethicist Paul Ramsey frequently warned that any argument for abortion could logically be also used as an argument for infanticide. As if to illustrate this, Dr. Francis Crick, of DNA fame, demonstrated that he was less concerned about the ethics of such logical extensions and proposed a more radical definition of personhood. He suggested in the British journal Nature that if "a child were considered to be legally born when two days old, it could be examined to see whether it was an 'acceptable member of human society." Obviously this is not only an argument for abortion; it's an argument for infanticide. Other line-drawers have suggested a cultural criterion for personhood. Ashley Montagu, for example, stated, "A newborn baby is not truly human until he or she is molded by cultural influences later." Again, this is more than just an argument for abortion. It is also an argument for infanticide. More recently some line-drawers have focused on a mental criterion for personhood. Dr. Joseph Fletcher argues in his book Humanhood that "Humans without some minimum of intelligence or mental capacity are not persons, no matter how many of these organs are active, no matter how spontaneous their living processes are." This is not only an argument for abortion and infanticide; it's adequate justification for euthanasia and the potential elimination of those who do not possess a certain IQ. In other writings, Joseph Fletcher suggested that an "individual" was not truly a "person" unless he has an IQ of at least 40. There are a number of biblical arguments against abortion. I'm less concerned about a killer being executed, but more concerned about innocent people in Iraq (or anywhere) being killed, and anyone would be ignorant to say that innocent people by the thousands haven't died there. I can totally see your point there. I almost agree with you, only I don't think I can say how I'd really feel about it without being in the situation. 21 YBP, you are quite convincing, I must say. You definitely have me questioning my stances on these things. After your lasts posts, I'd have to saying I'm leaning more towards the genderless take. The only thing I still don't get is this: I'm not saying people born with genetic mutations under natural circumstances should have been aborted...I'm saying that in cases of severe molestation (the other word can't be posted in here) I can't justify a 14 year old kid having to give birth to her dad's kid. It seems completely wrong to me.

As far as the fourteen year old thing, it IS tough. But two wrongs don't make a right, to use some wisdom from the mouth of babes. I would have to say that this person's sacrifice and unselfcenteredness will be rewarded in the next life. Christ tells people that his followers will suffer in this life for following Him. This may be the cross she has to bear. But this life is a drop in the bucket compared to the infinity of the next! Truth will set us free. Again, I appreciate your intellectual curiosity--something we ALL need more of, eh?

23 YBP: No problem...I always have an open ear & I'm glad you do too. Interesting you say "Truth" since we perceive our existence through dualities. I've often believed that our consciousness just isn't capable of knowing a mere fraction of what our universe or existence really is. Our bodies seem extremely limited in capacity to experience. Anyway, tangent. I see what you're saying, but it's hard for me to relate to since it hinges on a faith which I've never been able to believe in. Granted, I've gleaned some amazing values or truths from Christianity...but to me suffering now for a better eternal life echoes of many other religions where this was used as bait to do something horrible (9/11). I mean no insult to your faith by saying this...because that is my last intention...but since I have never been a true believer of any particular faith that results in a brick wall when trying to justify pro-choice or pro-life in religious terms on my end. It's tough in the 14 year old molested kid's case because while you want to be sympathetic to life, you also don't want to cause suffering as well.

25 I've never assumed that your opinions are based on just faith and no reason...I assure you that. Proving the existence of God is one thing, but in my mind I've pretty much deemed it impossible to prove which religion is right. Trust me, I'm not content with the "haze" and always seek truth. I've just always felt that religion was a way for people to try and explain the unexplainable. I've also think that in the past 200 years, science has illuminated our minds to many more truths than religion. I'm not content with just science though...like I said, I am open to all discussions and views. I do not conclude anything as an absolute being that I'm only in my early 30's.

As far as established religions, we are material beings who live in a material world (hope I don't sound like Madonna here). Because we are not completely spiritual beings, we need concrete, material things to guide us. The Second Person of the Trinity materialized to found a New Covenant (as predicted in the OT), where founded a religious body with a visible head and promised to be with it until the end of time. Even Prots with an axe to grind against Catholicism admit believe this and admit it's the R.C. Church. The Bible says seek and you shall find. Germans Let Terrorist Walk, Blame U.S.

While the U.S. detains terrorists until they are no longer considered a threat, Germany gives them lawyers, subject them to trials, and releases them based upon insufficient evidence. And when all is said and done, the German courts blame the U.S. for not providing the information necessary to convict them.

The presiding judge of the German Federal Court of Justice, Klaus Tolksdorf, announced that the verdict in the acquittal of Abdelghani Mzoudi would stand and he was now a free man. Mzoudi was accused of training at an Al-Qaeda camp in Afghanistan and paying bills of the terrorist cell in Hamburg that was responsible for the 9/11 attacks. Mohammed Atta, the mastermind behind 9/11, was Mzoudi's roommate in Hamburg.

The decision by the German high court is likely a harbinger for the outcome of the appellate proceedings against Mounir El Motassadeq, a terrorist buddy of Mzoudi, who was convicted and had his verdict overturned on appeal because judges decided he didn't get a fair trial because a witness in U.S. jurisdiction was not allowed to testify.

Evidently, the German judicial system is ineffective because the U.S. is unresponsive. Of course, blaming the U.S. for every conceivable problem anywhere has become sport.

Because when that crazy Wilbanks chick hopped a bus to Vegas, Grace was the first to declare her poor, nervewracked, devastated boyfriend a murderer. Not only did the poor man think that his wife was abducted and possibly dead, but he was being accused of it on national television. If I was him I would have hunted Nancy down and gutted her like a fish on live television. But hey, I'm crazy like that.

10 Hi, I just stumbled across this site and dont have all that much to say, but i did want to comment on how awful Nancy Grace is. I have no idea how this woman has her own show. She is annoying and arrogant. If you do not voice the SAME EXACT opinions as Nancy Grace there there is no need what so ever to appear on her show. Any guest that says anything other than her thoughts is quickly dismissed. Why the hell does she have other speakers on the show? Why doesnt she sit there in her ugly clothes and go on a rant on her own for an hour...no need for others except maybe the camera guy. I am SO glad that Michael Jackson was found innocent on all charges...of course because I believe he is innocent and a good man who is a misunderstood....but in addition to that I get to see Nancy Grace get so pissed because she was WRONG!! I love it!! She was so mean to him the entire duration of the trial. That witch was SO sure he was guilty...you would have thought she was molested by him....there was nothing that could sway her opinion. I cannot wait until her show in cancelled. 13 Nancy Grace is a typical southern "lady for show" who is more concerned with presenting a morally perfect front than she is about anything else. She became a lawyer after her fiance was murdered in some sort of quest for justice, but she dropped that act without skipping a beat in favor of becoming a T.V. star. It's a good thing that she was only a mediocre attorney at best, because he is devoid of ethics. To even compare Greta Van Susteren to Tweety Bird is like comparing the Three Tenors to New Kids on the Block. One may be more your tastes, but one may also mean you are a mindless sheep impressed by shiny objects. Greta single handedly jump started the Holloway case and offers unbiased and intelligent insight into the case. Nancy's high points include stuffing her face with a sandwich to in an attempt to make a joke about her crusade against Michael Jackson and accusing the groom of the runaway bride of murder before knowing anything about the case. We should round up Grace, O'reilley, Kavuto, Tom Cruise, Bush, Paris Hilton, and Jackson and send them to fight the good fight on the front lines in Iraq. Let them spend a few months sleeping in tents, dodging hand grenades and weapons fire, and not being given basic luxuries like soap, hot food, and socks. My guess is that all would come back with a totally new outlook on the world... if they made it back alive, that is.

Amnesty International Calls for Arrest of Bush, Bono to be named Czar of World

I used to belong to Amnesty International. No joke. During my lunch break in high school I would sit under a big U2 poster writing letters to South Africa begging the release of this or that jailed activist. But not now, oh no, not now.

First the leader of Amnesty makes the disgusting and immoral comparison of Camp X-Ray to Soviet gulags (which I debunked here), next they decide to call on Noam Chomsky of all people to defend their position (check out the video link on the right of the page), and now John Leo (Via Mighty Righty who got it from Captain Ed with a big hat tip to Filthy Allah) notices something I had forgot: this is the same group that wishes the Zeropeans to nab top officials and try them for crimes against humanity.

Man, am I glad I let my membership dues go unpaid for so long.........I'm totally on for the The Bipartisan Anti-Inflammation Pledge of 2005, but I reserve the right to call people I disagree with 'ca-ca heads' at will!! Seriously, some words are bad, but others are fighting words.

US Led NATO to Save Muslims from Mass Starvation (once again, but don't expect any credit)

It looks like US led NATO forces will finally begin to do something about the mass-starvation induced by Islamist militants in the Sudan's Darfur region. It's been way too long in the making, and let's hope whatever planning needs to be done gets done quick. Children in the region are dying today thanks to the relentless onslought of Islamist militia forces and their supporters in Khartoom.

Do you think the US or its European allies will get credit for, once again, coming to the aid of Muslims? Don't hold your breath. Expect the reaction from the Islamic world to be a) too little too late. The US let tens of thousands of Muslims die (ignoring the fact that they died as a result of other Muslims actions) b) the US is once again invading a Muslim country in a Zionist inspired crusade (remember, it was the 'victory' over US forces trying to end mass-starvation in Somalia that inspired Osama bin Laden to take his war against us up a nocth).

The Dread Pundit Bluto asks if this signals the end to the UN since NATO seems to be doing pretty much all of what the UN was supposed to be doing.

2 I'm skeptical still. Hate to say it, but Canada announced a 100 personnel force to go to Sudan late last month. About 20 of that force would be used as security purposes. Some members of Parliament were not happy however, demanding a 1000 personnel force. Anyways, this mission was rejected by the Sudanese government saying that they will only accept AU forces in the area and aren't interested in any help from non AU countries. Apparently, Canada's decision was made without consulting Sudan. It's also kind of sad considering the Sudanese government funds the very militia that is doing the killings, yet they don't want the help. Anyways, I'll believe all of this when it actually happens.

5 Yes. As for the "NATO's going into Sudan to help Muslims again" comment, this implies that NATO has done this before - which it didn't. Bombing the Serbs 10 years ago was done primarily to keep Turkey and Greece from fighting each other (which they would have, if the situation had gotten even more out of control), not to "help the Muslim Kosovars." The fact that the KLA (which received a fair bit of western "aid") was populated by the same kind of Islamic fascist villainy that the GWOT is trying to stamp out these days is, in a word, ironic. Helping the Muslims of Kosovo was secondary, played up by the "genocide" which, these days, appears to have been another crock of shit beefed up with stellar intelligence gathering. Should NATO help in Sudan? I don't think so. NATO's a defence force, not a humanitarian one. Let the UN do this.

6 Maybe I'm being simplistic here, but what is the UN doing? They set up refugee camps and hold "talks". They do a little hand wringing followed by more "talks". They air drop a few bags of rice and some penicillin and talk some more. The refugee camps are attacked and more die. UN Agencies are expelled and the killing and the starvation just keeps going on. Maybe, but the UN does have its peacekeeping force - which, before you completely rip it to pieces, was actually pretty effective up until maybe 10 or 15 years ago. Like Iraq, you only hear the bad side of it. They do a lot of good in hostile environments. Also, give the UN a little bit more flexibility to defend itself in hostile situations. Rwanda occurred because too many people at the top were trying to handle the situation with one hand tied around their balls. Bosnia wasn't really much different. I still think the UN, being more of a humanitarian organization than NATO, is better suited for this kind of mission. NATO's a military powerhouse, but I doubt they're that adept at knowing how to distribute food/medicine aid. The only way you'd get the two coordinated is if the UN was in charge, and I doubt that would be a popular move with a lot of people.

11 All too often though the UN peacekeepers carry guns but they're not allowed to use them. Whether or not it's a popular move shouldn't matter. It never has before. I'm not entirely dissing the UN. They have some pretty serious problems and I'm quite critical of them for those things, but I'm not unreasonable. However, their bureacracy has gotten pretty bad when it comes to distributing aid and it often takes quite a while before they get in motion. Look how long it took them to react to the tsunami in the southeast. And then they criticized other countries for showing them up. Well, it needed to happen fast and they were dragging their feet. My point is exactly what you brought up. It worked up until 10 or 15 years ago. How much longer does it have to not work? I'm not arguing that I think NATO is a better alternative because I'm not convinced of that either.

Marines Detain 16 American Security Contractors in Iraq

Marines in Fallujah are now reporting an odd incident in which 16 American and 3 Iraqi security contractors were detained for firing at US soldiers and Iraqi defense forces last month. Some may jump to the conclusion that this is evidence of a 'shoot first, ask questions later' mentality among these paramilitary forces, but I would caution against that. Friendly fire incidents are very common in combat situations (think back to Pat Tillman), especially in places like Fallujah that have been hotbeds of terrorist activity in the past.

Still, the fact that the Marines detained the men for some time does indicate that they were, at the very least, royally pissed at getting shot at by Americans. more...

They treated fellow Americans who also served their country in the military prior to becoming contractors like dirt. Fifth Man Detained in CA al Qaeda Case, More Arrests to Come

Multiple news agencies reporting that a fifth man has been detained in the Lodi, CA, al Qaeda cell investigation. Broadcast media is also reporting that the FBI expects to make more arrests. Further, search warrants have been executed on the Farooqia Islamic Center and the Lodi Muslim Mosque.

Reports also indicate that officials are backing off of earlier claims on the specificity of targets. Yesterday, an affidavit used to obtain the arrest warrant noted that potential targets included "hospitals and large food stores". The amended affidavit makes no such claim. Further, the FBI is backing off of the claim as to the location of the terrorist training camp and that photos of high-ranking US officials including President Bush were used for target practice.

Yesterday a number of pundits, including myself, questioned whether the fact that the US had intelligence reports indicating the location of jihadi training camps was evidence that Pakistan was being less than 100% cooperative in the Global War on Terror. Could pressure from the State Department, hoping to avoid a potential diplomatic fiasco with Pakistan, have forces the change?

Among the changes was the charge that one of the training camps was near Rawalpindi. Because Rawalpindi is the headquarters of the Pakistani military, it would be difficult to believe that the Pakistani military was not complicit in the camps.

I'm going to cross post this update here and in include it in my post from yesterday here. That earlier post will serve as an archive on this case.Fox News:

Five men, including two father and son pairs, have now been arrested as federal law enforcement officers try to determine whether they have uncovered a network of Al Qaeda (search) supporters in Northern California.
Father and son Umer and Hamid Hayat were arrested over the weekend in Lodi, Calif., on criminal charges. Three Pakistani citizens are also being held on immigration violations. Lodi is an agricultural community 40 miles south of Sacramento.
Two law enforcement sources have confirmed to FOX News that there is a connection between the Hayats and the Pakistani citizens....
The U.S. Immigration and Customs Enforcement (ICE) agents also have arrested Mohammed Adil Khan, Shabbir Ahmed and Khan's 19-year-old son, Mohammad Hassan Adil, for immigration violations. All three are citizens of Pakistan and Khan is affiliated with the Farooqia Islamic Center near Lodi, Calif. Ahmed is a citizen of Pakistan who currently functions as the Imam of the Lodi mosque.
Those three men are expected to eventually appear before an immigration judge.
An FBI affidavit says Hamid Hayat first denied any link to terror camps, but then told agents he attended an Al Qaeda camp in Pakistan for six months.
A law enforcement source confirmed to FOX News that search warrants have been executed at two mosques, homes of the Hayats, as well as that of the Lodi Muslim Mosque's imam. The case is now described as "ongoing investigation by the JTTF," the joint terrorism task force. FOX News was told that the connection between the Hayat's and Khan Ahmed "is more than just a meeting, there are many connections, here and possibly Pakistan."

1 We are getting the same crap in the SF Chronicle. Today there was the ongoing story of the investigation. Then there was a side article about the Muslims' "fear" of retaliation. They brought up the fact that somebody threw something at a Pakistani grocery store in 2001, right after 9.11. Gee. Then they interviewed one young man who insisted that there are no training camps in Pakistan. The obvious solution, of course, is for the Muslim community of Lodi to stand up and state loudly that they do not support terrorism or jihad. Flag Desecration Images From the Religion of Patriots

I had seen this story earlier at Jihad Watch, but didn't see the video until Michelle Malkin linked it. Michelle says "jump", I say "how high?" Also, you might want to follow her e-mail advice. Anyway, after seeing the video I'm disgusted. Since I know some people don't actually click the video links, I went ahead and took some screen shots of the video. If ever there was a clear 'fighting words' defense for assault, here it is.

UPDATE: Thanks to Wunderkraut for pointing to this post by Jay Tea over at Wizbang. He makes a good point about our reaction to flag desecration vs. the childish actions of Muslims over Koran abuse. However, he is way off the mark in the rest of the post. As a loyal follower of the Commissar (who advocates vigorous debate amongst ourselves), I must stand up and point out that my right-wing friend at Wizbang makes a serious logical error.

No freedom or liberty can be understood as anything but ordered and contextual. What this means is that what is thought of as a liberty in one context must be weighed against other liberties, and that sometimes these acts may be even considered criminal. From the Schenck (1919) case, for insance, comes the famous (if not discredited) example that people generally have the liberty to say whatever they wish, but they cannot yell fire in a crowded theater. The context of the theater changes the permissible action of shouting fire.

War also changes the context. We are in a war with jihadi inspired terrorists. In the context of war, embedded in the further context of a community which may have at least some minor percentage of those that are sympathetic to the cause, then advocating for the cause of the enemy ceases to be protected speech. In fact, this is a classic example of of the exception carved out in Brandenburg v. Ohio (1969): "Freedoms of speech and press do not permit a State to forbid advocacy of the use of force or of law violation except where such advocacy is directed to inciting or producing imminent lawless action and is likely to incite or produce such action"

I would argue that the word imminent ought to be dropped from the legal rule set up in Brandenburg. If 9/11 has taught us anything it is that terrorist acts may take years of planning. It has also taught us that our freedoms and liberties may be used against us in order to destroy those very liberties.

So, do I want flag desecration to be forbidden? No, of course not. What I do want is for incitement to take up arms against the US to be forbidden when the US is in a shooting war. more...

You seem to have a habit of not reading up on anything before you start berating people. Do you know who was bankrolling these guys and why their website went down for a while? I'll let you Google it. I'm not going to do all your work for you. Do you know there are reported instances being investigated of them threatening individuals who speak out against them? 39 Rusty, the crux of my thesis is that I LIKE it when our enemies and other assholes go to such lengths to point themselves out. I'm far more concerned about sleepers and other covert agents; I believe the authorities got lots of pictures and will give lots of attention to those "Islamic thinkers" in the future. And while I understand that certain things change during wartime, the idea of desecrating a flag posing such an imminent threat doesn't pass my personal "smell test." Now, for advocating the violent overthrow of the government, and giving "aid and comfort" (which I understand has to mean something tangible, not just saying nice things about them), I'll buy the rope for hanging myself (thank you, Home Depot). But when it's limited to just abusing a flag, I'll content myself to laughing at them -- and keeping an eye on them in the future. J.

48 YBP I'm not sure but it may be A.B.A.T.E. Last year there was about 20,000 bikes. Same kind of deal as the Sturgis and little Sturgis KY rallies. I intend to sit on the porch a while and check out the parade of freaks and bikes. I used to ride an old CB750 Honda quite a bit. Maybe in a few years I'll be able to take that up again.

50 Yeah the former president of the Joliet chapter is from my hometown. They are for the most part quite a bit of fun. Just don't ask about "business". His daughter was cool and a lot of them are just working stiffs like anyone else. Just watch out for the guy with tkob on his jacket. It was a different Spanish judge that had Pinochet arrested in Britain back in '98. Nonetheless, it seems odd to me that judges might instigate this sort of action on their own, rather than rely on a formal investigative/prosecutorial team. Verdict: Accidental mistake made in the heat of a battle plus exhaustion from long intense fighting. One thing is clear, the International Left is launching an all out war on the War on Terror and their targeting the military, now that their preferred target, Bush, has proved hard to get.

23 Yes, Garzon had this case briefly and didn't do anything with it. He is a serious anti-terrorism judge and I don't think he wanted anything to do with this case. Probably needs good working relations with the US. Never heard of this judge. I know the family wants compensation and this could be part of that effort. The interesting this is this could totally ruin what's left of Spain/US relations if Spain plays this one wrong. I don't think the US cares one way or the other and will not take it seriously.

25 The Spanish court system, I believe, makes the judge very much like the eqivelant of a prosecutor. That is to say, judges are not 'neutral observers' of a conflictual fight like in the US. So judges have broad investigative powers...which sometimes, like here, they obvioulsy abuse.
